Mark Toland is a native of Asheville. Mark attended The Asheville School, graduating in 1981. He attended Colorado State University in Fort Collins, Colorado and obtained his Bachelor of Science Degree in Accounting from the University of North Carolina at Greensboro in 1986. He went to work for the “Big 8 Firm” KPMG Peat Marwick in their Baltimore, Maryland office. In 1991 Mark became a partner in the firm Worley & Toland, P.A. Through various mergers and name changes the firm exists today as Toland CPA Group, P.A. Mark spends time in both the Hendersonville and Asheville offices. His concentrations are Mergers and Acquisitions, Sale of Business Enterprises, Real Estate Development, Bankruptcies, and Tax & Business Consulting. Mark’s outside interests include fly fishing and hunting - which he pursues as often as possible. Mark serves on the Board of Directors of The Cradle of Forestry Interpretive Association (The Birthplace of Forest Management in America) and has been Treasurer and Executive Committee member for the last 9 years. He is a Board Member of the North Carolina Wildlife Habitat Foundation. Employee Misclassification in the Spotlight
Employee misclassification is int the spotlight as a way to reduce the tax gap.
Employee misclassification of workers as independent contractors is in the spotlight as the Government Accountability Office (GAO) and Congressional Research Service (CRS) have released reports and recommendations on the issue. IRS reportedly is embarking on an employment tax audit of selected employers nationwide, and a recently introduced bill would revammp so-called "Section 530" relief.
The CRS recently summarized the employee-vs-independent contractor issue and reported that the last IRS estimate ws that 15% of employers misclassified 3.4 million workers as independent contractors rather than as employees causing an estimated total loss of $1.6 billion in taxes.
Representative James McDermott (D-WA) has introduced legislation that would make it more difficult for employers to receive protection from a potentially large employment tax assessment after incorrectly classifying a worker as an independent contractor. The legislation, if passed, would also increase information reporting penalties.
